Criminals are exploiting the COVID-19 pandemic to defraud innocent people, including sending fake emails and texts purporting to be from various organisations. Do not open emails or click on links from senders you do not already know. If in doubt, contact the organisation direct on the original details you have for them (not contact details included in the email). If you’ve been scammed, report what’s happened to Action Fraud, the UK’s national centre for reporting fraud and cybercrime.

Yes. The latest government guidance states if a student is moving permanently to live back at their family home, this is permitted. We would recommend that if you do plan to leave, you look over our accommodation FAQ's for further guidance on your contractual obligations.

I am supposed to be starting university in September. Is there any point in me going this year or shall I defer until next year?
University campuses have been closed this term by the Covid-19 outbreak and there is no guarantee how far they will open in the autumn. The University of Plymouth has not yet indicated how teaching will be delivered in 2020/21 and you may wish to be wary of committing to a course that may not meet your expectations. Before you make a firm choice next month, the higher education watchdog, Office for Students, says your university should give you “absolute clarity” on whether courses will be online, on-campus or a mixture. And if the information isn't available next month it must be provided before clearing in August.
Once you have all the information, you need to weigh up what's important to you. Bear in mind the universities minister says you'll have to pay full fees even if you're learning online - but if you are offered distance learning you could potentially save on accommodation and other living expenses.

If you, or someone you know, have been affected by domestic abuse or violence, the following organisations may be able to help. If you are in immediate danger, you should dial 999. Victims of domestic abuse are now able to use the private consultation rooms at Boots to access support and advice. Victims of domestic abuse who have a confirmed place in a refuge can now travel on trains free of charge.

What do I do if I'm facing difficulties with paying gas and electric bills?
We know that many students live in properties with gas and electricity included in the rent.However, there are also students whose circumstances are different and may be facing difficulties with gas and electricity payments, especially those who rely on part time earnings or zero hours contracts to supplement their income.
The government has signed an agreement will all UK domestic fuel suppliers to ensure continued access to gas and electricity for the most vulnerable during the coronavirus outbreak.

If I stay home in semester 3 do I still have to pay rent
Unless the government announces any changes to the legislation, the situation remains as it was when you signed the tenancy. Your accommodation contract with your landlord is a legally binding contract. You are, therefore, required to pay the rent for the duration of the fixed term.
You can ask your landlord to release you from the contract in these circumstances, but it is unlikely that the landlord will agree.
You will continue to receive your student finance from SFE to contribute to your rent. If you are struggling financially, you could consider making an application to the university financial support fund.

Full time students and students studying part time on a full time course do not have to pay council tax. If there are members of your household who have a council tax liability, the government has set up a hardship fund and you should contact your local authority for more information.

Do I still need to pay my rent?
Probably. There is no payment break or holiday for renters. You can only pause your rent payments if your landlord agrees or they release you from your contract early. You may be able to negotiate with your landlord, but as you have signed a legally binding contract you will be liable for the rent for the duration of the contract. You should receive your student finance in the usual way in order to meet your living costs including your rent. If your gas and electricity are included in your rent, you should be able to recover this element of your rent as the actual usage of these will be lower than the predicted amounts.

For your safety and that of others, it is our advice that viewings do not take place until further notice.
If you wish to proceed with viewings then we ask that you take the precautions below:
Do not attend a property viewing if you have recently returned from an impacted area, have symptoms (a new continuous cough and/or a high temperature) or have had any contact with anyone with symptoms
Where offered by the landlord/agent, please use hand sanitiser/hand washing facilities when entering and leaving a property. If you have hand sanitiser then it is advisable to take this with you.

Ask if alternative viewing options are available, such as 360 degree viewings or showing properties via video or recorded film

Should I continue to allow contractors to visit my rented property to complete repairs and maintenance?
The government’s ‘further businesses and premises to close’ guidance states that work carried out in people’s homes, for example by tradespeople carrying out repairs and maintenance, can continue, provided that the tradesperson is well and has no symptoms.
It is important to ensure that Public Health England guidelines, including maintaining a 2 metre distance from any household occupants, are followed to ensure everyone’s safety.
No work should be carried out in any household which is isolating or where an individual is being shielded, unless it is to remedy a direct risk to the safety of the household, such as emergency plumbing or repairs, and where the tradesperson is willing to do so. In such cases, Public Health England can provide advice to tradespeople and households.

Should I tell my landlord/letting agent if I have left or plan to leave my student accommodation due to the pandemic?
Yes we strongly advise all students to contact their landlord/letting agent ASAP to let them know what their plans are regarding the pandemic and if they will be leaving the property empty for a considerable amount of time. No work should be carried out by a tradesperson who has coronavirus symptoms, however mild.

With some mortgages you can apply for a ‘mortgage payment holiday’ if money is tight. The mortgage payment holiday will provide flexibility in repaying your mortgage by allowing you to apply for a mortgage holiday or reduced payments. The period in which you can apply has been extended until 31 October 2020.

My rent includes payment for utilities like gas and electricity. Can I request a refund of this element of rent even if my landlord requires me to pay rent until the end of my tenancy?
Your landlord is not permitted to make a profit from the resale of gas and electricity. If your rent includes an amount for gas and electricity, you can reclaim any overpayment at the end of the tenancy. You will need to have the meter readings when you moved in and at the end of the tenancy (ask your landlord to send you a photograph of the readings). You should ask your landlord to provide you copies of the utility bills so that you can work out the refund due. Example: Your rent includes £10 a week for bills over a 50 week contract. You only use £400 worth of utilities during your tenancy period. Your landlord should refund £100.

I have left my belongings in my student room but what happens if I am not able to travel back to Plymouth to collect them at the end of my tenancy?
The Torts (Interference with Goods) Act 1977 means that the landlord must follow certain steps before disposing of property left in accommodation after the end of a tenancy. We suggest that students get in touch with landlords as a matter of urgency to discuss arrangements for property to be returned should they be unable to return to their accommodation before the end of the tenancy.

My landlord/letting agency is refusing to release me from my tenancy even though I am no longer living in the property. Can I withold my remaining rent?
Unless the government announces any changes to the legislation, the situation remains as it was when you signed the tenancy. Your accommodation contract with your landlord is a legally binding contract. You are, therefore, required to pay the rent for the duration of the fixed term or they can take action against you or your guarantor if you have one.
Your landlord can take court action if you owe them money. If the court decides you should have paid the money, you will be asked to pay it as part of the judgement. You may also be asked to pay the landlord's court costs.
If you still don’t pay the money after the court has decided you should, you may receive a further judgement that can negatively affect your credit rating in the UK. This may make it difficult for you to borrow money or pass reference checks for rented accommodation in the UK in the future.
Remember that a letting agency is an intermediary acting on behalf of a landlord. A letting agency is not, therefore, able to decide to cancel a tenancy. That decision rests with the landlord.

Can I get out of my tenancy agreement on the basis of "frustration"?
This is a complex area of law. "Frustration" can be used to end a contract if it becomes impossible to perform it. This usually applies in extreme circumstances only and, if a landlord refuses to accept the frustration argument to end a contract, legal proceedings would need to be taken to prove that the coronavirus outbreak meets the definition of extreme. The court process, including rights of appeal to higher courts, is likely to be costly and take a long time to be concluded.

There has been no indication that the government intends to change the legislation to enable students to be released from their tenancies. A proposed amendment to the Coronavirus (Scotland) Bill allowing students to be released from their tenancies imediately was defeated in the Scottish Parliament on 1 April 2020.

Yes. If you landlord does not want to evict you or your tenancy has come to an end, he can bring a claim against you or your guarantor in the Small Claims Court. This is usually an online process and does not always involve attending a court hearing in person.

My landlord wants to carry out my regular monthly property inspection, but I feel this is an unnecessary risk. Do I have to let it go ahead?
Routine or non-essential inspections or repairs should be postponed as far as possible. Landlords could consider conducting inspections or consultations with tenants via smartphone or video call. Emergency repairs must still be carried out. Landlords and their agents/contractors must practice social distancing when attending a property for these purposes. Most importantly, a pragmatic, common-sense approach should be taken at all times.

My letting agent is refusing to give me the contact details for my landlord due to GDPR. Can they they do this?
You are entitled to be told the name and address of your landlord under section 1 of the Landlord and Tenant Act 1985. If your letting agent refuses to provide this information, you will need to send them a letter detailing that pursuant to section 1 of the Landlord & Tenant Act 1985 they must provide you with your landlord’s full name and address within 21 days. If the letting agent does not respond they can be fined.

Should I sign up for accommodation for September now?
The UPSU Advice Centre always cautions against signing up for accommodation too early and this is particularly relevant in the current circumstances. We do not yet know when or how academic teaching will be delivered for the 20/21 academic year. Plymouth benefits from a good supply of student accommodation, both in terms of student halls and shared houses. Students are likely to be able to negotiate reduced rents if they delay signing up for a tenancy and should remember that signing a tenancy is entering into a legally binding contract which cannot be cancelled before the expiry of the fixed term without the express agreement of the landlord. The Advice Centre offers a tenancy checking service throughout the year.

With Lockdown being eased, can I now return to my accommodation to remove my belongings?
The Government have recently updated their advice for students wishing to return to collect belongings. You may now travel back to recover your belongings so as long as you follow the precautions laid out in "staying safe outside your home". We would recommend that you contact your accommodation provider in advance, to notify them of your intention to collect your belongings and arrange a suitable time.

You will need to notify your accommodation provider of the date you intend to leave. You will continue to pay your rent as normal until this point.

You should not agree to viewings of your accommodation unless you are satisfied that there is no risk of transmission of coronavirus to you or your housemates. You could offer to arrange a video tour of the accommodation if you wish.

Your landlord can’t force you to let people into your home for viewings. The government says landlords shouldn’t look for new tenants unless you’ve told them you want to move out.Your landlord can go to the court if you refuse to let people in for a viewing and your tenancy agreement says you have to. It’s unusual for the court to make you let people into your home.

If your employer has designated you as a "furloughed worker", the government will cover 80% of your wages provided you were employed and on your employers PAYE payroll on or before 1 March 2020. The University have a short term Hardship Support Grant that is available for students who are suffering financial hardship as a direct result of the current COVID-19 pandemic. Examples of where the University may make a financial award are to help out with housing and food costs, travel expenses, technology costs associated with online learning, and other immediate/short term financial challenges.

If your total household income has dropped by at least 15% since the 2017 to 2018 tax year, you can ask for a current year income assessment, which may lead to you receving a higher amount of finance.

I've been relying on finance from my parents to support me but the Covid-19 crisis means they cannot continue to support me financially. What options do I have?
We would strong advise all students to ensure that they have sufficient funding in place prior to enrolment. If they enroll and subsequently withdraw as they have insufficient income, this will count as a year of study and could impact on future student finance entitlement. Students may wish to consider deferring their studies until the economic situation improves.

Can university students get their tuition fee refunded for disruptions to teaching because of Covid-19?
The Department for Education has indicated that it is possible for students to get their fees back. In a statement, it said that if universities are “unable to facilitate adequate online tuition then it would be unacceptable for students to be charged for any additional terms”. To claim a refund, students first need to complain directly to their university. If that is unsuccessful then students in England or Wales can lodge an appeal with the Office of the Independent Adjudicator (OIA).
