Terms

Filming: Media, external

  • You give Your express consent to Your actual or simulated likeness to be included for no fee within any film, photograph, audio and/or audiovisual recording to be exploited in any and all media for any purpose at any time throughout the world. This includes filming by the police or security staff which may be carried out for the security of customers or the prevention of crime.
  • Smoking within the Venue is strictly prohibited.  UPSU reserves the right, without refund, to eject any person found smoking in the Venue.
  • Canvassing:  You shall not bring into the Venue or display or distribute at the Event any sponsorship, promotional or marketing materials.
  • Data protection: Except to the extent that UPSU is required or permitted by law to do otherwise, personal information provided by You to UPSU will only be used in accordance with the Data Protection Act 1998 and any consents given by You in relation to Your personal information.

 

Timings:

  • Timings of the Artists are subject to change.
  • Acts/lineup are also subject to change.
  • Tickets cannot be exchanged or refunded unless the performance is cancelled, rescheduled or where there is a material change to the Event
  • You may only leave and then re-enter the Venue during an Event at the discretion of the Venue.  Otherwise there shall be no re-admissions or pass-outs of any kind.  Depending on the type of Event, every effort to admit latecomers will be made at a suitable break in the Event, but admission for latecomers cannot always be guaranteed.

 

Complaints

  • If you have a complaint about the venue or event please speak to a member of security who will try to assist and in turn, if necessary, contact a Duty Manager immediately during the show and the issue will try to be resolved.
  • Complaints after an event should be sent in writing (via email) directly to Complaints@upsu.com

 

  • It is your responsibility to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event.  Where an Event is cancelled or re-scheduled, UPSU (University of Plymouth Students’ Union) will use its reasonable endeavours to notify You using the details You provided at the time of ordering.  UPSU does not guarantee that You will be informed of such cancellation before the date of the Event. It is also your responsibility to inform the point of sale from where you bought the Ticket of any change to the contact address, telephone number or email address you provided at the time of purchase.
  • “Force Majeure” means any cause beyond UPSU’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments.  Subject to the provisions of Condition 2, UPSU will not be liable to You for failure to perform any obligation under the Conditions to the extent that the failure is caused by Force Majeure.
  • The total refund for a Ticket shall be the face value of the Ticket purchased.  Personal arrangements including travel, subsistence, hospitality or accommodation relating to the Event which have been arranged by You are at Your own risk.  Neither UPSU nor the Promoter shall be liable for any loss of enjoyment or wasted expenditure in addition to refunding the face value of the Ticket.
  • You may not re-sell or transfer a Ticket if prohibited by law.  In addition, re-sales or transfers of Tickets may be prohibited for certain Events, pursuant to the specific terms and conditions of those Events (for example, but not limited to (a) charity Events, (b) Events where age restrictions apply because of the content of the Event or licensing requirements, or (c) balloted Events).  Where a Ticket is offered for re-sale in accordance with the Conditions, You must provide the buyer with full details of the Ticket.  Full details include (if printed on the Ticket) the relevant block or tier, and row and seat number.  The buyer of a Ticket must be made aware of the Conditions and any other terms and conditions that are specific to the Event.  You should check whether any special terms or conditions apply before offering a Ticket for resale. Free tickets are often provided for specific reasons limiting their transferability.
  • UPSU reserves the right to conduct security searches and confiscate any item which in the opinion of UPSU may cause danger or disruption to other persons at the Event or is one of the items not permitted in the Venue as listed in the Conditions (including those items listed in this Condition 22).  You shall not bring all or any of the following into the Venue: (a) smoking materials, (b) laser pens, (c) animals (except guide dogs), (d) Your own food and drink (unless permitted by the Venue), (e) bottles, cans or glass containers (unless permitted by the Venue), (f) any item which may be interpreted as a weapon (including sharp or pointed objects such as knives), or (g) illegal substances. Notwithstanding anything else in the Conditions, neither the Promoter nor UPSU shall be liable for any loss, theft or damage to confiscated items.

 

Sports Centre - Refund Policy

  • Membership cancellations or the freezing of memberships are only considered if you leave University employment or have a medical condition or illness that prevents you from using the facilities. In the case of an illness a note from a GP or medical professional will need to be submitted to the Nancy Astor Sports Centre. Any refund will be on a pro-rata basis, agreed by the Sport Centre Manager.
  • If a class has been paid for and is cancelled at lease an hour prior to commencement of the class a refund will be available. Contact with the Nancy Astor Sports Centre will need to be made in the first instance.

 

Shop: Items, Purchasing, Postage & Returns

Shop Items

  • By purchasing clothing from upsu.com and UPSU you agree to the following Terms & Conditions:

Purchase

  • Each item will be charged at the stated price plus the appropriate P&P cost as detailed on the website and all promotional material, relative to the postage destination. A receipt email will be sent upon completion of your order. Please check all details – if there is anything missing from your order or any details are incorrect, please email us immediately at upsushop@su.plymouth.ac.uk. Failure to advise us of any errors within 24 hours of receipt of the confirmation will result in you still being liable for the full cost of the items.

Postage

  • The charges for postage and packaging are added to the cost of the item and are necessary for us to dispatch your garment to you. There are four charges – UK, Europe and International Zone 1 and Zone 2.
  • Should you order more than one item the postage and package charge will reflect this. In some cases it can take up to 28 days to deliver our items.

Returns & Refunds

  • If you have a genuine reason for wanting to return your item, please contact upsushop@su.plymouth.ac.uk, explaining the reasons why the garment is to be returned. Your item must be returned unworn and in the original packaging. You must pay for the cost of the return, it must be sent by recorded delivery and you should keep your receipt as proof of postage. We will not accept returns in the following cases:
    • The garment has been worn (unless there is a provable quality issue)
    • The item has been proven to be deliberately damaged
    • The garment is the wrong colour – you are liable for the colour selection you make and we keep a copy of your order to confirm your selection 
  • All refunds will be issued by UPSU. In the event of an item being returned due to quality issues, we will take this up with our supplier and advise you of the outcome.

 

Events: Tickets, refunds, ID entry

Events Admissions Policy

  • The University of Plymouth Students’ Union is a charity based organisation with the welfare of its members being its core mandate. With this in mind and working inside the framework of the 2003 Licensing act, the Students’ Union has a duty of care to all of its members & customers.

Non-refundable tickets

  • Once purchased, all tickets are non-refundable under any circumstances.

Age

  • In compliance with licensing laws, entry to the nightclub will only be granted to over 18's who are in compliance with the conditions below. Unless the event is otherwise stated as an under 18 event.

Student Entry

  • Entry to Plymouth Students’ Union is granted on production of a valid Union card only. This includes the university campus card. It does not include NUS/NUS Extra cards issued by University Plymouth Students’ Union.

Guests

  • Guest are required to have nationally recognised photo ID to prove who they are.

ID

  • All customers may be asked for ID at the bar to receive service, suitable photo ID (driving licence or passport) stating your date of birth must be provided upon request. Please note that your University Card is not acceptable ID as it does not detail your date of birth.

Searching

  • Please be aware that as a condition of entry you may be asked to be searched on your way into the premises or even once inside the premises. You are entitled to refuse the search if you so wish, if you refuse to allow a search to be conducted, you will not be allowed entry to UPSU.

Right of Refusal

  • The duty manager reserves the right to refuse entry to any person, without giving a reason.
  • In accordance with the conditions of sale on your ticket "Ticket holders who are unable to use their ticket due to refusal of entrance are not eligible for a refund."
  • Any inappropriate behaviour will be dealt with by the security staff or Venue Managers or the Police will be informed.

Lost Ticket

  • No refunds will be given for lost tickets to events.

Last Admission

  • University Plymouth Students’ Union venues operate a Last Entry time for each event. You must be in the queue by the advertised time or you will not be allowed admission.
  • Refunds will not be given to customers who turn up after the last entry time.

Re-entry

  • The venue operates a re-admission policy – please receive a stamp on exit to gain re- entry

Drugs

  • University of Plymouth Students’ Union has a zero tolerance policy on drug misuse.
  • Any person found using or dealing drugs will be detained and the police will be called.

Acts

  • UPSU cannot guarantee entry and viewing of acts at UPSU events based on capacity of venues available. 

Conditions: Venue and Events

  • All tickets are sold according to the conditions. Please read the conditions carefully before purchasing your ticket.
  • Check your tickets: It is your responsibility to check Your Tickets is for the correct event. Please check your Tickets on receipt carefully and contact UPSU immediately if there is a mistake.
  • Special requirements: If You have any special access requirements or concerns about any special effects (lighting, sound, audiovisual ect) which may be featured at the Event, please discuss any such issues before purchasing the Tickets with UPSU by contacting UPSU. UPSU will use its reasonable efforts to assist with any such special access requirements or concerns.
  • Valid Ticket: You must produce a valid Ticket to gain access to an Event and You must keep possession of such Ticket at all times during the Event.  Your Ticket may be invalidated if any part of it is removed, altered or defaced. UPSU will not be responsible for any Ticket that is lost, stolen or destroyed.
  • Duplicate tickets UPSU may issue duplicate Tickets in its sole discretion.  If UPSU issues a duplicate Ticket, it may charge a reasonable administration fee.
  • Alter the advertised event: Tickets are sold subject to UPSU’s right to alter the advertised Event as reasonably necessary. 
  • Not be liable:  UPSU will not be liable for any loss, injury or damage to any person (including Yourself) or property however caused: (a) in any circumstances where there is no breach of a legal duty of care owed by UPSU, (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury as a result of a breach of a legal duty of care owed by UPSU); or (c) to the extent that any loss or damage results from breach by You of any of the Conditions.
  • Nothing in the Conditions seeks to exclude or limit any liability of UPSU for death or personal injury caused by its negligence, fraud or any other type of liability which cannot by law be excluded or limited.
  • Tickets are personal revocable licences and shall at all times remain the property of UPSU.  Any Ticket obtained in breach of the Conditions will be void. Any person seeking to use a void Ticket may be refused entry to, or ejected from, the Venue without refund, and may be subject to legal action. Void Tickets are non-refundable.
  • Behaviour: UPSU reserves the right to refuse You entry to and/or eject You from the Event and/or Venue (and may take appropriate action to enforce this right) in reasonable circumstances including without limitation (a) for health and safety or licensing reasons, (b) if You behave in a manner which has or is likely to affect the enjoyment of other persons at the Event, (c) if You use or display threatening, abusive or insulting words or mannerisms or behave in a manner which may provoke a breach of the peace, (d) if, in UPSU reasonable opinion, You appear to be acting under the influence of alcohol or drugs, (d) if You fail, when required, to produce proof of identity or age, (e) if You refuse to comply with UPSU’s security searches, (f) if You breach these Terms, or (g) if Your Ticket is void.  No refunds will be given to You if You are refused entry or ejected due to Your own behaviour.
  • Warning: Prolonged exposure to loud noise may cause damage to your hearing.

 

UPSU Summer Ball Terms and Conditions of Entry

TICKETS

  • Summer Ball tickets we will not be replaced if they are lost or stolen. UPSU will not be responsible for any lost or stolen tickets.
  • Only customers holding a valid Summer Ball ticket will be admitted to the Event. You must retain this ticket on your person at all times during the Event.
  • The Summer Ball is an over 18 event, all ticket holders must be over 18 to gain access to the event.
  • UPSU does not issue refunds for tickets except under exceptional circumstances. In the event that you have bought a ticket but no longer intend to attend the event, UPSU is happy for you to resell your ticket to another student of Plymouth University.

DRESS CODE

  • Formal dress only, black tie, lounge suit, cocktail dresses, ball gowns. Strictly no jeans, no trainers, no t-shirts.

THE EVENT:

  • The line-up of the event cannot be guaranteed and may be subject to change.
  • Performance times are subject to change
  • Ticket holders give consent to filming and sound recording as members of the audience, for purposes of future promotion of UPSU and Plymouth University.
  • We will not be responsible to make any refund or meet the costs of any alternative travel arrangements or for any loss of enjoyment or other indirect loss as a result of an Event not running to the precise advertised times.
  • Proof of age may be requested at any time whilst in the venue.
  • Performance areas are subject to capacity and your ticket does not guarantee viewing of acts.
  • UPSU does not permit excessive consumption of alcohol. Customers must not allow themselves to become excessively inebriated. Free tap water is always available at the bar, please ensure you drink plenty of water between alcoholic drinks so as to enjoy yourself responsibly.
  • Customers who are drunk or who appear to be drunk will be refused service. If you are refused service please respect our decision.
  • Pressuring others to drink dangerous mixtures or excessive quantities of alcohol is not permitted and will not be tolerated.
  • UPSU have a zero tolerance policy against substance abuse.
  • UPSU have a zero tolerance policy against discrimination and/or harassment in any form.
  • It is an offence to obtain alcohol for someone who is drunk. Any customer found to be purchasing or obtaining alcohol for someone who is drunk will be asked to leave the event.
  • If your behaviour indicates that you have consumed an excessive amount of alcohol you will be asked to leave the Event.
  • There will be no re-admission to the event if a person leaves. Only under exceptional circumstances at the discretion of the door team will you be allowed to leave the ball and re-enter
  • We reserve the right to search all persons and personal property upon entry to and while at the event: Glass items, candles, knives, animals, smoke canisters, poles or banners and any items which in the absolute discretion of the Event Management Team are considered to be a risk to the safety of those attending the event, affect the enjoyment of others or the running of the event are Prohibited.
  • The Event Management decision is final.

ENTRY:

  • No admission after published last entry time of 11pm.
  • Entry to the event will be your Summer Ball wristband and Student ID along with proof of age ID if requested, which is only valid UK Driving licence, Passport, Citizen card, PASS card,
  • Admission will be refused to persons who appear or act in a manner that gives rise to reasonable suspicion that they may be under the influence of drink or controlled substances / legal highs.
  • Only bring in guests ticket holder you know and trust. They are your responsibility (max 1 guest per student) strictly over 18s only.
  • No drinks may be taken into the event.

EXIT:

  • Please leave and walk home quietly with respect for local residents.
  • No drinks may be taken off the premises.
